So say you have 1 toon inside for 1 hour 2 min (enough to make sure he is over the limit) and the other toon dies twice and spends 52min inside and 10min outside in the hour. The second toon will get the message about too many instances in an hour the first will be fine to continue with another instance.
This is an interesting idea, but can't be true because if it were after you reset 5 times and waited outside your time would never count up to 1hr.

I always recorded the times I entered an instance and a new one was available exactly 1 hour from that time regardless of if I was inside or out.

Also I have done that simple test of dying and yes it does subtract from the instance limit. I just tried it after being in 4 instances in the last few minutes. After 1 died and came back I left and reset. Everyone else made it in, but the one who died got the too many instances message and wasn't able to get into another for 45mins(1hr from the first)

The above link is a good mod for keeping track of instance resets it was written quite some time ago and the last I used it was in 3.0 but it should still work just fine.

BTW smoooth I don't have the same problem you do if a char dies in the instance and has still gone over an hour of in instance time within the last hour he can get in on the 6th instance. If I have him outside for 10min and wait 10min inside before resetting for the 6th he gets in just fine. If I go out and reset prior to waiting until he has hit 60min of instance time he can't get in and has to wait. I just tried it and it worked for me...

Gotta remember how WoW counts the timers. The reset timer does not start counting I believe until the first reset...so:

    Reset 1: Minute 0
    Reset 2: Minute 13

    Reset 3: Minute 26

    Reset 4: Minute 39

    Reset 5: Minute 52

There's your 5 minute wait time. Remember, the clock doesn't click until you reset it...

A guildie I was helping in Hellfire got the same message. He 2-boxes and I was using three of my five. One of his toons got the message and couldn't continue to the next instance. He wrote a ticket and was told that it is a known bug and should be fixed soon. We ran all of them the next day w/o trouble. Note: that was last week before 6/2/09 patch.
This. I've also talked to a GM about it awhile back and this just said it was a bug and to give it about 5-10 mins which I did and everything was fine again. It was just something that happens every once in awhile. Although I have not had it happen in a long time and even when it did it was only when I was cutting it really close on the 5 per hour mark.

If it's still occurring to you just go grab a bite to eat or take a 5-10 min break and all should be fine again.
