Blizzard would have taken the servers down to fix this whether anyone "took" anything or not. The multiboxing community has high standards in terms of hacks and cheats and botting. Blizzard accidentally making certain epic gear cost nothing doesn't fall into any of those categories. I'm pretty sure they don't manually remove each item from every person. The rollback would be a global action.
Certain gear costing nothing is a bug. Purchasing that gear during this time is taking advanatage of a bug, this is against the EULA and TOS that YOU agreed too. Blizzard also has high standards in terms of abusing bugs in-game. It's a shame really that probably no action/discipline will be handed out as so many took part. But this is no excuse to do it. I for one didn't.
If next patch, you suddenly find that your shaman do 1 million damage per LB if you use a tremor totem, does that mean that using a tremor totem in that time would be against the EULA? No, it means Blizzard screwed up.
A vendor displaying the wrong price is simply incorrect data being sent from the serverside, not a legitimate bug built into the game code. There's nothing outside normal gameplay mechanics involved in using a vendor or even in a vendor having stuff for free.
