You do realize that you have no right to play the game? Blizzard allows you to play their game, and if you reject their EULA or TOS you are not allowed to play the game. You don't own the software, the characters, the items or access to the game. You play solely at Blizzard's discretion to allow you to play which they can revoke for any or no reason at any time.

Rights are not acquired just because you've done something before. If that was true, the first time someone committed a new crime they'd never be charged and since they did it before, they could continue to do so after there was a law against it. That would be insane.
