Wouldn't it fall under #2? the "official rules, regulations" of Blizzard about it's game are the EULA/TOS.
Most people use "illegal" in the place of something like "violation of TOS/EULA". While I tend to consider it inaccurate, I also understand that they don't mean that you're subject to arrest or prosecution, but that you're breaking the contract that you agreed to abide by.
