Agreed. In the US, it bugs me when people confuse civil law (torts) with criminal law. Bugs me more when people say something is illegal when in fact it is against Blizzards TOS. Not the same thing at all.

Wouldn't it fall under #2? the "official rules, regulations" of Blizzard about it's game are the EULA/TOS.
Most people use "illegal" in the place of something like "violation of TOS/EULA". While I tend to consider it inaccurate, I also understand that they don't mean that you're subject to arrest or prosecution, but that you're breaking the contract that you agreed to abide by.
