I'm a little gray on the TOS and what is programmable key stokes and such... But is it legal to program an x-keys button to include a modifier such as <CTRL>F1?

Yes. Get crazy, put an alt in there too ;).
Don't use any of the macro features like delays and such...

yupyup -- the easy rule is -- if you can do it in-game, you can do it with software/hardware. :) Try binding a ctrl+key in your keybindings. Since you can do it there as a combination, you shouldn't be afraid of using it on your xkeys. :)
