If your name is incorrect, call Blizzard's billing phone number and see if you can get the name updated. They will probably ask you for the SQA and other account details (perhaps even your CD Key number).
The point is, the account is owned by the person whose name is on the account.
The account can only be played by the person whose name is on the account and that person's minor dependent child.
If you don't fit in that bucket, you can get banned. So I suggest you call Billing to try and fix it.
Though why people DON'T use "the right" name boggles my brains. Unless you're trying to hide some shady behaviors or are SERIOUSLY paranoid about identity theft....
